Terms of use
This document is a draft for review before live paid services launch. Paid ticketing currently uses test payments only.
About these terms
These terms apply to everyone who uses StandWith at standwith.com.au: people who organise fundraisers (organisers), people who buy tickets (buyers) and anyone who visits a page. By using StandWith you agree to them.
StandWith is run by Jon Lee Taylor, a sole trader based in New South Wales (ABN 50 154 134 393). In these terms, “StandWith”, “we” and “us” mean that business.
How we handle personal information is covered in our privacy policy.
What StandWith does
StandWith is a tool that helps organisers publish a fundraising page, run events and sell tickets. The organiser runs the fundraiser and the event. StandWith provides the page, the ticketing and the payment collection.
StandWith is not a charity. We don’t run the events listed on StandWith, and we don’t check every claim an organiser makes. We don’t give legal, tax or financial advice.
Your account
You need an account to organise a fundraiser. You must be 18 or older, give us accurate details and keep your password to yourself. You’re responsible for what happens in your account. If you think someone else has used it, reset your password and tell us.
You don’t need an account to view a page or buy tickets.
If you organise a fundraiser
When you publish a page or sell tickets on StandWith, you agree that:
- what you say about the fundraiser, the cause and the event is true and not misleading
- if you’re raising money for someone else, they (or, for a child, a parent or guardian) know about the fundraiser and are happy for you to run it
- you have permission to use every photo and piece of writing you add, including permission from anyone pictured
- the money raised goes to the purpose you describe on your page
- you’ll run the event as described, or tell us and your buyers promptly if it changes or is cancelled
- you’ll answer buyers’ questions about your event
- you’re responsible for working out whether your fundraiser needs a licence, authority, permit or registration where you are, and for getting it
- you’re responsible for any tax, including GST, that applies to your fundraiser
- you’ll only use buyers’ details for your event, and handle them in line with our privacy policy
Some features, such as raffles and silent auctions, may come with extra requirements. We’ll show you those before you turn the feature on.
Your page and content
You own what you add to StandWith. You give us permission to host it, show it on your public page, and display it where your page is shared (for example, link previews on social media) for as long as your page is on StandWith.
A published page can be seen by anyone with the link. Don’t add anything you wouldn’t want shared, such as someone’s home address or private health details, unless they’ve agreed.
Paid tickets and the money you raise
When buyers pay for tickets, the payment is processed by Stripe and received by StandWith. Buyers’ card statements show StandWith. We then pay the money raised to you by bank transfer.
- StandWith keeps a fee from each paid order. We’ll tell you what it is before you start selling paid tickets.
- We’ll tell you when payouts happen before you start selling paid tickets.
- We may hold a payout while a refund, a payment dispute or a concern about the event or the page is being sorted out.
- If a buyer is refunded or wins a payment dispute after we’ve paid you, we may take that amount from your next payout or ask you to pay it back.
Free tickets don’t involve any payment or fee.
If you buy tickets
- The price at checkout is the total you pay. There’s no extra card surcharge.
- The event is run by its organiser, not by StandWith. Questions about the event itself, such as times, parking or what’s included, are best answered by the organiser.
- Your tickets and order reference are shown after you check out and sent to the email you give us. Keep them handy for the event.
- If you need a refund, contact the organiser or contact us with your order reference. An organiser can ask us to refund an order, and approved refunds go back to the payment method you used.
Nothing in these terms takes away rights you have under the Australian Consumer Law.
What’s not allowed
You can’t use StandWith to:
- raise money under false pretences, or for a person or cause that doesn’t know about it
- pretend to be someone else, or to be a registered charity when you’re not
- sell or promote anything illegal, or run an activity you don’t have the permission you need for
- post content that is hateful, harassing, violent, sexually explicit, or that exposes someone’s private information
- send spam, or collect other people’s details without their consent
- interfere with StandWith, get around its limits, or access accounts or data that aren’t yours
Reports, removal and suspension
Anyone can report a page. If we think a page or account breaks these terms, or could harm buyers, beneficiaries or others, we may ask for more information, edit or hide content, unpublish the page, pause ticket sales, hold payouts or close the account. Where it’s appropriate we’ll tell you why and give you a chance to respond.
Changes to StandWith
We’re improving StandWith all the time, so features may change. We’ll try to keep it available, but we can’t promise it will always be free of interruptions or errors. If we change our fees, we’ll tell organisers before the change applies to them.
Our responsibility to you
Some rights under the Australian Consumer Law can’t be excluded, and these terms don’t try to. Apart from those rights, and to the extent the law allows:
- StandWith is provided as it is
- we aren’t responsible for how an organiser runs a fundraiser or an event
- we aren’t responsible for indirect losses, such as lost profits or opportunities
- where our liability can be limited, it is limited to supplying the service again or paying the cost of having it supplied again
Organisers agree to cover losses StandWith suffers because of a claim that arises from their fundraiser, their event or their content, or from their breach of these terms.
Closing your account
You can ask us to close your account at any time through the contact page. We’ll unpublish your pages. We keep order and payment records for as long as we need them for financial records, and we’ll finish paying out any money owed to you, less fees, refunds and disputes.
Changes to these terms
We may update these terms. We’ll change the date at the top of this page, and if a change makes a real difference to organisers, we’ll email them before it applies. If you keep using StandWith after a change, the new terms apply.
Governing law
These terms are governed by the law of New South Wales, Australia.
